Terms of service
Last updated: October 20, 2026
These Terms of Service & Terms of Sale (the "Terms") govern your use of uspackingequipment.com (the "Website") and every purchase you make from us. The seller is US Packing Equipment LLC, a Texas limited liability company (Texas Secretary of State File Number 806787401), 10820 Composite Dr #1021, Dallas, TX 75220, United States ("US Packing Equipment," "we," "us," "our").
By using the Website or placing an order, you agree to these Terms, our Return & Refund Policy, our Shipping Policy and our Privacy Policy. If you place an order on behalf of a company, you confirm that you are authorized to bind that company to these Terms. If you do not agree, please do not use the Website or place an order.
1. Who we are and how we sell
- We are an online reseller of packaging machinery. We do not manufacture the equipment we sell, and we do not hold inventory.
- Your order is fulfilled by the manufacturer, which ships the equipment directly from its facility to the delivery address you provide.
- We sell to businesses and to private customers. Most of our products are commercial or industrial equipment. Before you order, please check the power supply, compressed air, space and installation requirements stated on the product page.
- We sell and ship only to customers with a delivery address in the United States.
- Product descriptions, technical data and images are based on the manufacturer's documentation. Manufacturers may change designs and specifications without notice, provided that function and performance are not materially affected. Images may show optional equipment that is not included in the base price.
2. Orders
- Placing an order is an offer to purchase. We may decline or cancel an order, for example if a product is unavailable from the manufacturer, if there is an obvious error in price or product information, or if we cannot verify your payment. If we decline or cancel an order, we refund any amount paid in full.
- All orders are placed via a written quote. Before you pay, the quote states the price, the shipping, handling, crating and delivery charges, and the estimated lead time. A quote is valid for the period stated on it.
- Please check your order carefully before you submit it. Cancellations are governed by our Return & Refund Policy and Section 5 below.
3. Prices and taxes
- All prices are in U.S. dollars (USD).
- Unless stated otherwise, prices do not include shipping, handling, crating, liftgate or other delivery charges, or sales tax. These charges are stated in your written quote before you pay.
- Sales tax is charged where required by law. If your purchase is tax-exempt (for example, for resale), you must provide a valid exemption or resale certificate before you place your order.
- Prices may change at any time. The price that applies is the price shown at the time you place your order.
4. Payment
- Payment in full is required in advance, at the time you place your order. We do not offer payment on account or credit terms.
- The accepted payment methods are stated in your written quote. Payment is due before we release the order to the manufacturer.
- We pass your order to the manufacturer only after your payment has been received.
5. Lead times, shipping and delivery
5.1 Lead times
- The estimated lead time is stated in your written quote (and on the product page where available). It is the time until the equipment ships from the manufacturer. We base it on information from the manufacturer. Transit time is added to the lead time.
- Lead times are estimates, not guaranteed delivery dates. However, we state a lead time only when we have a reasonable basis for it. If neither your written quote nor the product page states a lead time, we will ship your order within 30 days of receiving your order and payment.
5.2 Delays: your right to cancel
We comply with the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435):
- If we learn that we cannot ship your order within the stated lead time (or within 30 days if no lead time was stated), we will notify you promptly, and in any case before the original shipping date has passed. We will tell you the revised shipping date.
- You may then either accept the delay or cancel your order free of charge. If you cancel, you receive a full refund of all amounts paid, including any shipping charges, within 7 business days.
- If you accept a delay, you may still cancel free of charge at any time before your order ships.
- If we cannot ship by the revised date, we will notify you again. Unless you expressly agree to the further delay, we will cancel your order and refund you in full.
5.3 Shipping methods
- Parcel shipments: Smaller machines ship by parcel carrier directly from the manufacturer. For example, AmeriVacS ships exclusively via FedEx from its factory in San Diego, California. Shipping and the manufacturer's handling fee are stated in your written quote.
- Freight shipments: Large machines ship by LTL (less-than-truckload) freight, usually packed in a wooden crate. For these machines, for example Maripak machines, freight and crating charges are quoted for each order before you pay.
- Ripack products: Ripack products ship directly from Ripack's facilities in the Chicago area, Illinois, by UPS or LTL freight. Multicover and Turbopack systems ship by LTL freight; freight is quoted before you pay.
- AIE products: AIE products ship from AIE in City of Industry, California, by UPS or LTL freight; freight is quoted before you pay.
- Omcan products: Omcan products ship from Omcan's U.S. warehouses by parcel carrier or LTL freight; freight is quoted before you pay.
- Bulman products: Bulman products ship from Bulman in Grand Rapids, Michigan, by parcel carrier or LTL freight; freight is quoted before you pay.
- Delivery conditions: Freight deliveries are made to a business address with a loading dock or forklift, unless you have ordered a liftgate, inside, residential or limited-access delivery. These services are charged extra and are quoted before you pay. You are responsible for unloading the equipment from the truck (unless liftgate delivery was ordered), moving it into place, and installing it.
5.4 Title and risk of loss
Title and risk of loss pass to you when the manufacturer (for Omcan products: Omcan) hands the equipment over to the carrier. We will nevertheless file and manage any carrier claim for transport damage on your behalf, provided you follow the inspection and reporting rules in Section 6.
6. Inspection on delivery
You must inspect every delivery immediately on arrival. Note any visible damage on the carrier's delivery receipt or bill of lading before you sign it. Report any damage, defect, missing item or wrong item to us in writing, with photos, within 5 business days of delivery (for Ripack products: within 3 business days of delivery; for Omcan products: damage within 24 hours of delivery and missing items within 3 business days of delivery). The details are set out in our Return & Refund Policy.
7. Returns and cancellations
Machines are generally non-returnable. The rules of the respective manufacturer apply. Returns require our prior written authorization. Our Return & Refund Policy sets out all details, including the AmeriVacS 1-week trial for standard machines.
8. Warranty
8.1 Manufacturer's warranty only
We do not manufacture the equipment we sell, and we do not give any warranty of our own. Every product is covered solely by the warranty of its manufacturer, which we pass through to you. The warranty terms that apply to a product are stated on the product page and in the documentation supplied with the equipment. Currently, the following manufacturer warranties apply:
| Manufacturer | Warranty |
|---|---|
| AmeriVacS | 2-year limited warranty from the date of delivery against electrical and mechanical defects. Normal wear items are excluded, such as heating elements, element posts, Teflon, pressure bar pads, gray/black rubbers and seal gaskets. The warranty is void if the machine is damaged through improper or negligent use or unauthorized repairs. It does not cover damage caused by acts of God, such as fire, hurricanes, floods or tornadoes. Defective machines under warranty that are returned freight prepaid will be repaired or replaced at no charge, at AmeriVacS' discretion. |
| Ripack | Ripack 3000: 10 years; Ripack 2500: 2 years; other Ripack products: 12 months, unless stated otherwise on the product page. For Ripack products, warranty claims after the first year are handled directly by Ripack, Inc.; we will give you the contact details. |
| Maripak | 3-year warranty on non-wear parts against manufacturing defects or faults, as stated by Maripak. Wear parts are not covered. For some models, the warranty can be extended in 1-year increments at additional cost, as stated on the product page. Where the product page does not state a warranty term (for example conveyors and spare parts), Maripak's warranty terms apply; details are available on request; we send them to you free of charge before you order. |
| AIE | 180 days from the date you receive the equipment, according to AIE's manufacturer warranty. Until the full warranty text is published on the product page, we send it to you free of charge before you order. |
| Omcan | According to Omcan's manufacturer warranty, as stated on the product page for each Omcan item number: for the Turbovac TS20 and TS40 tabletop models: Manufacturer warranty provided by Omcan. Exact coverage is confirmed in writing with your quote. For the other Omcan machines we sell: 1 year parts and labor. Per Omcan, equipment over 115 lb (52 kg) is serviced on site during regular weekday hours, and lighter products are covered by carry-in bench warranty (delivered to Omcan or an Omcan-authorized service center, freight prepaid). There is no on-site warranty at residential addresses unless specified otherwise. Parts subject to natural wear and tear are not covered, nor is damage from abuse, misuse, improper installation or maintenance, or modifications. The warranty covers the original user, is not transferable and is valid only in the country of purchase. The hot plate cover of Omcan wrapping machines is not covered. |
| Bulman | Per Bulman, its paper dispensers, cutters and racks are guaranteed to perform as designed when used properly and without modification. Bulman gives no fixed warranty period; issues are handled case by case. For Bulman packing tables, crumplers and accessories, the exact coverage is confirmed in writing with your quote. |
8.2 Warranty claims
Please contact us with your order number, the machine's serial number, a description of the problem, and photos or video. We will coordinate the claim with the manufacturer. For Ripack products, warranty claims after the first year are handled directly by Ripack, Inc.; we will give you the contact details. For Omcan products, report a defect within 30 days of discovering it; Omcan requires a copy of the bill of sale and/or the serial number. The manufacturer decides whether the product will be repaired or replaced. Unless the manufacturer's warranty provides otherwise, you are responsible for the cost of shipping the equipment to the manufacturer for warranty service.
8.3 Disclaimer
EXCEPT FOR THE MANUFACTURER'S WARRANTY PASSED THROUGH TO YOU AS DESCRIBED ABOVE, AND TO THE FULLEST EXTENT PERMITTED BY LAW, US PACKING EQUIPMENT MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Any guidance we give on selecting equipment is provided as a courtesy, based on the information you supply. You are responsible for confirming that the equipment is suitable for your application, including your products, packaging materials, utilities (such as electrical power and compressed air) and applicable safety and regulatory requirements.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO AN ORDER OR A PRODUCT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, IS LIMITED TO THE PURCHASE PRICE YOU ACTUALLY PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, PRODUCTION DOWNTIME OR LOSS OF PRODUCTION, SPOILED OR DAMAGED PRODUCT, COST OF SUBSTITUTE EQUIPMENT, AND LABOR COSTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
If you are a consumer, nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived or limited by contract.
10. Installation, operation and safety
You are responsible for having the equipment installed, connected and operated by qualified personnel, in accordance with the manufacturer's instructions and all applicable safety codes. This includes providing the required electrical supply and, where applicable, compressed air at the volume and pressure specified by the manufacturer.
Propane-fired equipment (for example Ripack heat shrink guns, Turbopack and Ripaflam) may be operated only by trained personnel, in accordance with Ripack's instructions and all applicable local fire and gas codes. Propane cylinders are not supplied filled. Conversions to natural gas may be carried out only by a qualified gas technician.
11. Force majeure
We are not liable for any delay or failure to perform that is caused by events beyond our reasonable control. Examples include acts of God, fire, flood, severe weather, epidemics, war, government action, labor disputes, carrier or supply-chain disruptions, and delays at the manufacturer. Your rights under Section 5.2 (cancellation in the event of delay) remain unaffected.
12. Use of the Website
- We make reasonable efforts to keep the information on the Website accurate. However, it may contain errors in descriptions, prices or availability. We reserve the right to correct any error and, if an order is affected, to cancel it with a full refund.

Product names, images and trademarks of manufacturers belong to their respective owners. You may not copy, reproduce or republish content from the Website without our prior written consent.

- The Website may contain links to third-party websites. We are not responsible for their content or practices.
13. Privacy
Our handling of personal information is described in our Privacy Policy.

15. Indemnification
You agree to indemnify and hold harmless US Packing Equipment and its members, employees and agents from any third-party claims, losses and costs, including reasonable attorneys' fees, arising out of your breach of these Terms, your violation of any law or third-party right, or the installation or operation of the equipment by you or on your behalf.
16. Governing law and venue
These Terms, and every purchase made under them, are governed by the laws of the State of Texas, including the Texas Business and Commerce Code, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The state and federal courts located in Dallas County, Texas, have exclusive jurisdiction over any dispute arising out of or relating to these Terms or any purchase, and you consent to the personal jurisdiction of those courts.
If you are a consumer, this clause does not deprive you of any protection or venue rights that you have under the mandatory consumer protection laws of the state where you live.
17. General provisions
- Severability: If any provision of these Terms is held to be invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions remain in full force.
- No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
- Entire agreement: These Terms, together with the policies referred to in them and any written quote we have accepted, are the entire agreement between you and us regarding your purchase. Any terms in your purchase order or other documents that conflict with or add to these Terms do not apply unless we have agreed to them in writing.
- Assignment: You may not assign your rights under these Terms without our written consent.
- Changes: We may update these Terms from time to time. The version posted on the Website at the time you place your order applies to that order.
